Notice of partial transfer of FOI request

I refer to the below FOI request and write to advise of the partial
transfer of your request to another agency.

Part of your request has been transferred to the Australian Transaction
Reports and Analysis Centre (AUSTRAC) for processing in accordance with
section 16 (1) of the FOI Act.

Section 16(1) of the FOI Act provides;

Where a request is made to an agency for access to a document and:

(a) the document is not in possession of that agency but is, to the
knowledge of that agency, in the possession of another agency; or
(b) the subject- matter of the document is more connected with the
functions of another agency than those of the agency to which the request
was made;

the agency to which the request was made may, with the agreement of the
other agency, transfer the request to the other agency.

AUSTRAC  will be responding to you in due course regarding the partial
transfer of the request to them.

ASIC will be responding to you regarding the remainder of your request.

For the purpose of calculating time frames, please note that the part of
your request transferred to AUSTRAC is taken to have been received by
AUSTRAC  at the time at which it was first received by ASIC, that is on 29
August 2016.
