Dear Ms. La,
Thank you for your letter dated 17 October 2025 regarding my FOI request (FOI ref: 2025/2082).
I am writing in response to your consultation notice under section 24AB of the Freedom of Information Act 1982. I wish to revise my request to narrow its scope and address the "practical refusal reason" you have identified.
My original request sought:
"documents recording or relating to any action taken pursuant to Part 9, Part 10 or Part 11 of the Administrative Review Tribunal Performance Standard for Non-Judicial Members."
I now revise the scope of my request. I am no longer seeking documents relating to Part 9 or Part 10.
The revised request is for:
1) All documents recording or relating to any action taken by the President pursuant to Part 11 of the Administrative Review Tribunal Performance Standard for Non-Judicial Members.
2) For the avoidance of doubt, this request specifically includes (but is not limited to) any correspondence sent by the President under paragraph 11.4 of that Standard.
I trust that this significantly narrower scope will resolve the practical refusal concerns and allow the request to be processed.
I look forward to your decision on the revised request.
Yours sincerely,
Rose
Dear Rose,
I refer to your Freedom of Information request lodged with the Tribunal on
6 October 2025 (FOI ref. 2025/2082).
Thank you for your response to the Tribunal’s consultation under s 24AB of
the FOI Act. I confirm that the Tribunal has accepted the revised scope
proposed by you, and the practical refusal concerns have now been
resolved.
I confirm that the revised scope is as follows:
1) All documents recording or relating to any action taken by the
President pursuant to Part 11 of the Administrative Review Tribunal
Performance Standard for Non-Judicial Members.
2) For the avoidance of doubt, this request specifically includes (but is
not limited to) any correspondence sent by the President under paragraph
11.4 of that Standard.
Request for an extension of time – s 15AA of the FOI Act
I have commenced the process of searching and collating documents which
fall within the scope of your request. Due to the large volume of
documents identified, I am seeking your agreement to extend the processing
time by 30 days under s 15AA of the FOI Act. I note that the processing
time paused during the s 24AB consultation period. Consequently, the date
for making a decision on your request was amended to 10 November 2025. If
you agree to an extension of time under s 15AA of the FOI Act, the revised
due date will be 10 December 2025. I would be grateful if you could
confirm by replying to this email that if you agree to this extension of
time.
If you have any questions, please contact me at [1][ART request email].
Thank you.
Kind regards,
Skye
