NDIA FOI Quarterly Statistics for 2024-2025 Q3
Dear Office of the Australian Information Commissioner,
I request access under the Freedom of Information Act (1982) to:
- A copy of the National Disability Insurance Agency’s “2024-2025 Q3” quarterly FOI statistical return form, submitted to the OAIC using the Statistical Returns portal.

Statistics
The OAIC publishes an Australian Government FOI statistics dashboard which
provides key freedom of information (FOI) data over the last 5 years, as
reported by Australian Government agencies and ministers to the OAIC under
the Freedom of Information Act 1982. This dashboard is updated quarterly

The OAIC does not hold documents of other Commonwealth agencies, nor for
other state agencies, or private organisations. The OAIC does not hold
Police Records or State Government Records. Further information on how to
access these types of records is here [3]Freedom of information requests

Accordingly:
1) if you are seeking to access documents of a particular
Commonwealth agency, you will need to make your request directly to the
relevant agency. For example, if you are requesting a copy of your visa
records, please make an FOI request and send it to the Department of Home
Affairs. Further details and information is below.
2) if you are seeking to access documents of a state or local
government agency, each Australian state and territory have separate FOI
legislation which governs information held by state government agencies.
Please contact the relevant agency as to how to make an application to
access the documents. For example, if you are seeking access to police
reports from the NSW Police Force, this agency is governed by the
Government Information (Public Access) Act 2009 (NSW) (GIPA Act); you will
need to contact NSW Police to find out how to make a GIPA application for
a police report.
3) if you are seeking to access documents of a private organisation,
which the FOI Act does not apply to, please contact the organisation
directly to find out how to access the documents you are seeking. For
example, if you are seeking to access hospital records or your medical
records, please contact these organisations directly.
4) You can request copies of documents directly from other
Commonwealth agencies, such as:

I note you have sought access to documents under the [1]Freedom of
Information Act 1982 (FOI Act), relating to:
A copy of the National Disability Insurance Agency’s “2024-2025
Q3” quarterly FOI statistical return form, submitted to the OAIC using the
Statistical Returns portal.
NDIA’s FOI statistics for Quarter 3 of 2024/2025 is expected to be
publicly available after 21 May 2025.
As this information will be obtainable through public resources on the
[2]Dashboard through our website, section 4 of the FOI Act describes a
document to be: (a document does not include material which is publicly
available).
In addition, section 12(1)(b) of the FOI Act notes if a document is
already publicly available, as part of a public register, a right of
access does not apply to publicly available documents under FOI.
As this information is generally made publicly available and should be
updated again next week by Wednesday 21 May 2025 to incorporate the latest
quarterly Data for the NDIA, would you please confirm by close of business
23 May 2025, if you are happy to withdraw your FOI requests to the OAIC?

following dates:

Thank you for your quick response and taking the time to gather those links for me.
Whilst I understand that the individual pieces information contained in the document I've requested could be gathered by navigating the (quite inaccessible) OAIC Dashboard (https://www.oaic.gov.au/freedom-of-infor...), the OAIC doesn't publish an agency's quarterly report data as a .xlsx or .csv file (or any other kind of readable table) on the data.gov.au webpage (https://data.gov.au/dataset/ds-dga-b0771...). Only annual/financial year data is published in this way.
I would consider the document I’ve requested to be a distinct document, because it isn’t available publicly in the same form that it’s sent in by the NDIA, to the OAIC. This is true regardless of whether the information found in that document is later used by the OAIC to create something that is published publicly.
If you view the 24/25 Q2 version of the statistical returns form document I requested, you can see how this differs considerably from what can be accessed on the dashboard: https://www.righttoknow.org.au/request/1...
I would also think that the fact I have successfully received these documents now in three FOI requests to the OAIC should support the claim that it can be obtained under the FOI Act.

I confirm that the OAIC received your email of 16 May. We are now consulting with the National Disability Insurance Agency regarding the documents you have sought to access (section 27 of the FOI Act).
A decision on your FOI request is due by Saturday 14 June 2025. Noting this is a non business day, we will attempt to have the decision ready and released to you by close of business on Friday 13 June 2025, however in any case, a decision will be provided to you no later than Monday 16 June 2025.

Thank you for the documents, it is much appreciated. I have one follow up question in regards to the document.
Have the NDIA provided any explanation for how "no exemption" was relevant/claimed for 220 personal requests (5.A), when there was only a total of 210 personal request decisions made during the quarter (3.A + 3.B + 3.C)?
