(RAP) from Saturday 24 December 2022 to Monday 2 January 2023 inclusive.

Searches are being carried out for any documents falling within scope of
your request for current versions of internal or otherwise non-public
policies or guidance with regards to deciding if ADHD can or should be
approved in a plan, and with regards to deciding how much funding should
be allocated for ADHD in a plan once ADHD has been approved to be in that
plan.

 

However, it will be difficult to search for documents falling within scope
of the third and fourth dot points of your request. Firstly, the names of
all Agency employees engaged at the level of SES Band 3 or above between 1
July 2020 and 30 September 2022 are not readily available. Secondly, even
if we were able to identify each employee engaged at that level, the
various email addresses they used during their period of employment with
the Agency could not be readily ascertained. Those email addresses would
be needed to carry out data searches to identify documents that might fall
within scope of your request. Fourthly, a data search cannot be requested
for any correspondence to or from such employees “that discuss whether
and/or how ADHD fits into the NDIS”. These words are not sufficiently
precise to act as key words and a search request for such correspondence
discussing ADHD would be likely to return many irrelevant results.

 

Therefore, we are seeking your help to narrow the scope of your request so
that we can provide the documents you are seeking.

 

You might consider revising the scope of the third and fourth dot points
of your request to:

o Limit it to correspondence discussing whether and/or how ADHD fits
into the NDIS to and from the Agency’s current Chief Executive Officer
and Deputy Chief Executive Officers; and
o Seek access to more precisely defined correspondence e.g.
correspondence discussing whether persons diagnosed with ADHD are or
should be eligible to become NDIS participants.

guidance with regards to deciding how much funding should be allocated for
ADHD in a plan once ADHD has been approved to be in that plan

Non-FOI feedback to pass to the relevant area:
1. One of the media TP drafts had 'ADHD is a learning difficulty'. Good thing that wasn't published. It's wrong, and one would expect the NDIA to know better.
2. It also refers to ADHD as 'neurobehavioural'. That is not the standard nomenclature. ADHD is a neurodevelopmental disorder. The only reason I can think NDIA would use 'neurobehavioural' instead is to try and suggest ADHD is not permanent or lifelong or inherent etc. So I would suggest that NDIA exclusively use 'neurodevelopmental'.

FOI feedback:
It took a long time but otherwise was quite helpful and didn't make spurious redactions. Thank you :)
