I have been advised by the relevant business area that the document you have sought access to under the Freedom of Information Act 1982 (the FOI Act) no longer exists as the notes were not retained after the hearing. In light of this, I'd appreciate it if you could advise me by close of business Monday 1 September 2014 whether or not you wish to withdraw your request. If I have not received advice from you by this time the department will process your request under the FOI Act.

Can I ask, Ben, why you instructed the Department to continue processing your FOI request even though Beth had advised the document had been destroyed?
Do you believe the document had not, in fact, been destroyed?
