Dear Government Information Officer,

Thank you for your response to my request for information about barristers' fees paid by the Crime Commission.

I would be grateful if you would please assist with another request that I wish to make.

I am seeking an extract from the 'register of interests' formerly kept by the Crime Commission pursuant to Crime Commission Regulations 2012, sub-regulation 7(4), recording potential conflicts of interest on the part of a Commissioner and/or Assistant Commissioner. I am seeking any entries in the register of interests in relation to Mr Peter Singleton, who was both an Assistant Commissioner and Commissioner.

It appears that this regulation was omitted from the more recent Crime Commission Regulations 2022, and there now may no longer be the same obligation of disclosure imposed on a Commissioner or Assistant Commissioner to disclose such matters.

The Crime Commission Regulations 2022 include a "repeal and savings" clause at Regulation 11, the effect of which is that any "act, matter or thing" that had effect immediately before the repeal of the Crime Commission Regulations 2012, continues to have effect under the more recent 2022 Regulations.

On that basis, sub-regulation 7(4) of the Crime Commission Regulations 2012 should still apply with regard to any historical records. That sub-regulation provides that, "A copy or extract from the record is to be made available on application in the approved form by any person on payment of the fee (if any) determined by the Commission."

I have, however, been unable to locate any 'approved form' for this purpose on the Crime Commission website.

Will this email correspondence suffice for the purpose of the application? Please advise of the correct position. If some other formal process is required, please let me know what must be done in order to gain access to these records.
