Extension of Time Request
Under s 15AA of the FOI Act, an agency may extend the initial processing period for dealing with a request by a further period of no more than 30 days if the applicant agrees in writing to the extension and the agency gives written notice of the extension to the Information Commissioner as soon as practicable after the agreement is made.

I would like to request your agreement to extend the processing period for your request by 30 days. I am requesting this extension of time from you to ensure the department has sufficient time to process and finalise your request in accordance with the FOI Act, noting delays due to the Easter break and ANZAC holiday and resourcing constraints in the relevant teams. Please be assured that your request is at an advanced stage of the process and we are working to process your request as quickly as possible.

If you agree to this extension of time, the due date for your request will be 22 May 2023. I would be grateful if you could let me know whether you agree to this extension of time as soon as possible or by COB 6 April 2023.

I refer to your request to the Attorney-General's Department (the department) under the Freedom of Information Act 1982 (FOI Act) for access to documents.

The purpose of this email is to advise you that part of your request has been transferred to another agency.
Under section 16(1) of the FOI Act, the department, with the agreement of the other agency, may transfer part of the request to the other agency if the requested document is not in the possession of the department but is in the possession of the other agency or if the subject matter of the document is more closely connected with the functions of the other agency.

The department, with agreement, transferred the below part of your request to PMC on 27 April 2023 as the subject matter is more closely aligned with that agency.

Timeframe for receiving your decision

The 30 day statutory period for processing your request commenced from the
day after the initial Department received your request.  As you kindly
agreed to an extension of time you should therefore expect a decision from
us, in relation to part (d) of your request by 22 May 2023.  The
processing period of 30 days may be extended in certain circumstances and
we will write to you separately regarding any extension of time.

 

Charges

Agencies may decide that an applicant is liable to pay a charge in respect
of a request for access to documents. If the Department decides that you
are liable to pay a charge, we will send you a preliminary assessment of
the charge as soon as possible.

The current due date for a decision on the requests is today 22 May 2023.
Documents within scope of the partial transfer to the Department have been
identified, and are under assessment in accordance with to the FOI Act.
However, the Department is not in a position to issue you with a decision
today.

 

Further work is required to:

·         Ensure that the Department has identified and retrieved all the
documents covered by the scope of the transferred request.

·         Complete the assessment and finalise the documents

·         Make a decision under the FOI Act.

 

I appreciate that you have agreed to an extension under section 15AA of
the FOI. However, unless further documents are identified, I estimate that
the Department will be in a position to issue a decision on your request

I am confused as to the nature of you're reply, given the request had been transferred to the Department of the Prime Minister and Cabinet, who picked up the request on 3 May 2023. Further, no email in the public chain sent on the Right To Know site exists being sent on May 1, such as the one referenced by your recent reply, let alone one asking for further adjustments.

Thanks for the clarification, but the question of this 14-day letter being sent though still hasn't been resolved. You can see through the entire history of the Right To Know public email thread a record of all emails sent and attachments included. As you can see very clearly, you haven't sent through any email on that date, or on a similar date with that attachment.

If I didn't have access to this document, how could I have possibly refined, revised, or insisted on my initial request?

such, the department considers your FOI request withdrawn in accordance

Yeah interesting, https://www.righttoknow.org.au/request/r... is the first time they mentioned anything about the 14 day consultation period. I've reported this thread to administrations so that they can confirm if there is a missing email or not.
