Request for unredacted copies of Documents 7 and 7a refused under FOI LEX 51816

The request was refused by Department of Social Services.

Dear Department of Social Services,

I am writing to request the following documents for the purposes of the FOI Act:

SCOPE:
Unredacted copies of Documents 7 (email) and 7a (attachment to email) originally refused under FOI LEX 51816 on the basis of a legal professional privilege exemption. These documents are sought on the basis the LPP exemption has been waived through the publication of a revised fact sheet and legal arguments advanced by the NDIA in numerous Tribunal cases finalised or progressed since commencement of these changes, which essentially disclose the substance of the advice.

Email
Subject: RESPONSE: URGENT To discuss application of NDIS Act Transitional Rules in AAT
Date: 4 October 2024

Attachment to Document 7
Draft DSS Questions (Final Version)

Should emails relating to subsequent changes to the fact sheet regarding the impact on AAT/ART reviews be reflected in these documents, please treat these as relevant.

Please treat names of SES staff as relevant. Please treat other names or contact details as irrelevant, including any which would otherwise invoke third party consultation delays.

END SCOPE

Yours faithfully,

Cat
