NICNAS has received your FOI request for access to the MCS report which
can be accessed here:

The Australian Government has endorsed the Web Content Accessibility
Guidelines (WCAG) version 2.0 for all government websites.  The MCS report
was removed as it did not meet these accessibility requirements.

I note that NICNAS is currently reviewing old (non-compliant) content with
a view to updating any relevant material in line with WCAG 2.0.

Dear Lewis,

From what I can see, you are responding on behalf of NICNAS. If that is correct, I think that someone has misunderstood my request.

I am not requesting a copy of the NICNAS report - as is clear from my request, I already have access to it at https://www.nicnas.gov.au/chemical-infor... What I want is the Department of Health's response to the report, i.e. any information that the Department of Health holds that relates to this report and its recommendations.

Could you please arrange for the appropriate person to respond to the request that I actually made.

In accordance with section 16(1) of the FOI Act, your request has been transferred from Health to the National Industrial Chemicals Notification and Assessment Scheme (NICNAS) as the subject matter of the documents is more closely related to the functions of that agency. Your email below has been forwarded to NICNAS for response.

 

1.  The email was received by the Department of Health.

 

2. Section 16 of the FOI Act states:

 

16 Transfer of requests

(1) Where a request is made to an agency for access to a document and:

(a) the document is not in the possession of that agency but is, to the
knowledge of that agency, in the possession of another agency; or

(b) the subject-matter of the document is more closely connected with the
function of another agency than with those of the agency to which the
request is made; the agency to which the request is made may, with the
agreement of the other agency, transfer the request to the other agency.

 

In this case initial consultation with NICNAS by Health revealed that at
least one document within the scope of the request was held by NICNAS
(section 16(1)(a)) and the request relates to a report generated by NICNAS
(16(1)(b)).

 

I hope this information is of assistance.
