Review of 'Case Management Guide - Applied Behavioural Analysis (ABA)'

Response to this request is long overdue. By law, under all circumstances, National Disability Insurance Agency should have responded by now (details). You can complain by requesting an internal review.

Dear National Disability Insurance Agency,

I refer to FOI 24/25-0913, which provides a single document - 'Case Management Guide - Applied Behavioural Analysis (ABA) - Draft'

The decision letter states:

'Please note that the document is currently under review and therefore in draft form. The previous version of this document is the obsolete document developed by the Quality, Strategy and Training Team that was determined to be irrelevant to your request.'

Plesae provide all information in relation to this document, since the request of FOI 24/25-0913. This might include (but is not limited to):

- Further draft versions fo the document.
- Any final version of the document.
- All internal agency correspondence about this document (e.g. emails, briefings, approvals).
- The relevant qualifications of the person or persons involved in the review and drafting process.

Yours faithfully,
David Wright

Dear David

Freedom of Information Request: Acknowledgement

Thank you for your request of 9 May 2025, made under the Freedom of
Information Act 1982 (FOI Act), for documents held by the National
Disability Insurance Agency (NDIA).

Scope of your Request

You have requested access to:

“…I refer to FOI 24/25-0913, which provides a single document - ‘Case
Management Guide - Applied Behavioural Analysis (ABA)  - Draft'

The decision letter states:

'Please note that the document is currently under review and therefore in
draft form. The previous version of this document is the obsolete document
developed by the Quality, Strategy and Training Team that was determined
to be irrelevant to your request.'

Plesae provide all information in relation to this document, since the
request of FOI 24/25-0913. This might include (but is not limited to):

- Further draft versions fo the document.

- Any final version of the document.

- All internal agency correspondence about this document (e.g. emails,
briefings, approvals).

- The relevant qualifications of the person or persons involved in the
review and drafting process…”

Can you please clarify what you are requesting when you refer to
‘qualifications’ of the person or persons involved in the review and
drafting process.

Irrelevant Information

Section 22 of the FOI Act allows an Agency to redact information from
documents if that information would reasonably be regarded as irrelevant
to a request for access.

Given the nature of your request, it does not seem that NDIA staff
members’ surnames and contact details would be relevant to you. When
replying to this email, can you confirm that such details are irrelevant
to your request for access?

Processing Timeframes

In accordance with section 15(5)(b) of the FOI Act, a 30-day statutory
period for processing your request commenced from 10 May 2025. This 30-day
period expires on 8 June 2025.

The 30-day period can be extended in several ways, including with your
agreement.

Unfortunately, it is currently taking us a little longer than 30 days to
process FOI requests due to a very high volume.

I am therefore seeking your agreement to a 30-day extension of time under
section 15AA of the FOI Act. If you agree to this extension, the new due
date for us to decide on your request will be 12 July 2025.

If you do not agree and we are unable to process your request within the
30-day period expiring on 8 June 2025, we will be deemed to have refused
your request, and you will not have a right to seek internal review of
that decision. You will, however, retain your right to external review by
the Australian Information Commissioner.

Please let me know if you agree to this extension by Tuesday 27 May 2025.

Disclosure Log

Subject to certain exceptions, documents released under the FOI Act will
be published on the NDIA’s disclosure log located on our website.

If you have any concerns about the publication of the documents you have
requested, please contact me.

Next steps

We will contact you using the email address and/or phone number you have
provided.

In the meantime, if you have any questions, please contact me at
[1][NDIA request email].

Dear Patrick

By 'qualifications' I mean knowledge and experience gained through education, training, and/or clinical practice.

By 'relevant qualifications' I specifically mean education, training and/or clinical practice in the field of ABA.

If it is the case that none of the person or persons involved in the review and drafting process possesses these specific qualifications, please include this information in your response.

Yours sincerely,
David Wright
