Under Lismore Councils Smoke free areas policy as published on your website smoking is prohibited within the Lismore CBD.

Pursuant to section 41 of the GIPA Act I apply for access to the following government information:

The number of fines issued by Lismore Council for smoking within the CBD area declared in this policy in the last twelve 12 months. (October 2024 - October 2025)

Furthermore, I also request that all fees and charges associated with this application be waived as Section 66 of the GIPA Act (and the associated guideline) allows for a discount of processing charges where the information sought is “of special benefit to the public generally. In the IPCs own guidelines public health is an explicitly declared example of a 'special benefit', of which this request covers.

Rather than waiving all fees and charges associated with your request &
accepting it as a valid GIPA application, I have decided to deal with it
informally. Regarding your enquiry as to the number of fines issued by
Lismore City Council for smoking within the CBD area declared in our
Smoke-free Areas policy in the last 12 months (October 2024 - October
2025), our Coordinator Law Enforcement Jody Hinds has informed me that NSW
Health are the regulatory agency for this function. Our policy was for
people to “self-police”; not for LCC to issue infringements.
