Surveillance of APSC staff

We're waiting for WS to read a recent response and update the status.

Dear Australian Public Service Commission,

Under the FOI Act, I seek a copy of any notices given to Canberra based APSC staff in accordance with the requirements s.13 of the Workplace Privacy Act 2011 (ACT) in relation to the surveillance of APSC staff including by use of building pass cards.

I’m willing to exclude the personal information of any person included in a relevant document other than the personal information of a public servant or statutory officer (noting paragraphs 6.152-6.154 of the FOI Guidelines).

In terms of the timeframe, that’s dictated by when the obligation imposed by s.13 of the Workplace Privacy Act 2011 (ACT) commenced (24 Aug 2011) and when my request was made (noting my request can only apply to documents in the possession of the APSC at the time of my request).

In terms of the ‘type’ of surveillance notices, my request refers to notices given in accordance with s.13 of the Workplace Privacy Act 2011 (ACT). If it assists, I’m happy to limit the ‘type’ of notices given in accordance with s.13 of the Workplace Privacy Act 2011 (ACT) to those given to Canberra based APSC staff in relation to RFID building pass cards issued to those staff (noting those cards are ‘tracking devices’ for the purposes of the Workplace Privacy Act 2011 (ACT)).

If it assists, and if it’s the case that the same form of notice is given personally to each relevant staff member, I’m happy to limit my request to just the template notice (rather than a copy of each personalised notice given to each relevant staff member).
