Under the Freedom of Information Act (1982), I would like to request copies of all documentation and correspondence on record, including but not limited to emails, letters, briefings and phone transcripts, regarding the asylum seeker Mohammad Albederee. Specifically regarding:

- Any plans to transfer the asylum seeker for reasons of healthcare/treatment
- Any claims by the asylum seeker against Wilson Security, DIBP, or other parties on Manus Island regarding an alleged assault
- Any Detail Incident Reports regarding the asylum seeker
- Any documentation of injuries sustained in 2014

I write to you in relation to your FOI Request seeking access to:

 

Under the Freedom of Information Act (1982), I would like to request
copies of all documentation and correspondence on record, including but
not limited to emails, letters, briefings and phone transcripts, regarding

The purpose of this email is to seek further clarification from you in
relation to the timeframe for documents subject to your request.

 

To assist the Department in identifying all relevant documents, it would
be appreciated if you could specify a timeframe for your request.
Currently your request does not include a specific timeframe, other than
your fourth point, which I note includes 12 month period. Therefore, your
request could be interpreted broadly and would include a large number of
documents.

 

Please respond to the Department, in writing, to confirm the timeframe you

Third party consent

You are seeking access to a third parties personal information. By
identifying the individual within your scope; and making your scope
accessible to the public domain (via the right to know website); it is not
possible to de-identify the individual from the documents. Therefore, a
release of any documents could be connected to the individual concerned
and provide further personal information that is not known to the wider
community about that individual. Section 47F(1) of the FOI Act provides
that documents are exempt from release where this would involve
unreasonable disclosure of personal information; and be contrary to the
public interest. As you are seeking access to documents containing
information about a third party it will assist this office to make a
decision on your request if you provide written consent from the
individual concerned.

 

If you cannot obtain consent and you still wish to access the documents,
you should write to this office setting out reasons why you believe the
release of their personal information would not be unreasonable or
contrary to the public interest. In cases where consent cannot be obtained
the Department may be required to consult the individual(s) concerned
prior to making an access decision. This is a requirement under section
27A of the FOI Act.  

 

Alternatively, you may wish to consider withdrawing your request to access
a third parties personal information.   

 

Request for an extension of time

The current due date for your request is 24 November 2015. Due to the
number of requests currently being processed by our office, we will not be
able to finalise your request by the original due date. 

 

The Department seeks your agreement (under s.15AA of the FOI Act) to
extend the timeframe for the processing of your request by 30 days. This
would extend the due date for your request to 24 December 2015.
