Dear National Library of Australia,

Under the reasons in the FOI ACT, could you please arrange for provision of documentation held which provides an explanation of the planned and unplanned outages of the Trove website from July 1, 2021 to February 3, 2022.

Include the length of time of the outage, if the outage was planned or unplanned (if planned was the outage longer than originally forecast or planned for) what were the root causes for each outage and what actions have been taken to reduce the impact of future outages.

Please include any relevant emails, reports, system logs or other correspondence held.

Dear Mr Frankaland

 

This is a charging notice issued in accordance with subsection 29(1) of
the Freedom of Information Act 1988 (FOI Act) in relation to your request
made under the FOI Act on 3 February 2022 with regards to Trove outages
(attached). This notifies you that you are liable to pay a charge under
section 29 of the FOI Act for the request made on 4 February 2022.

 

Reasons for imposing the charge

 

In imposing the charge, I have taken into account the that the functions
and powers given by the FOI Act are to be performed and exercised, as far
as possible, to facilitate and promote public access to information,
promptly and at the lowest reasonable cost. In accordance with the [1]FOI
Guidelines issued by the Australian Information Commissioner (FOI
Guidelines), the ‘lowest reasonable cost’ objective should be interpreted
broadly in imposing any charge under the FOI Act. That is, an agency
should have regard to the lowest reasonable cost to the applicant, to the
agency, and the Commonwealth as a whole.

 

In making the decision to impose a charge, I have taken into account the
public interest in disclosing the documents requested, that is, whether
the giving of access to the document in question is in the general public
interest or in the interest of a substantial section of the public.
Documents you have requested would not be in the general public’s interest
or in the interest of a substantial section of the public.

 

I currently do not know of any financial hardship the estimated charge
would cause you.

 

The charge and preliminary assessment of the charge

 

You are liable to pay a charge of $285, based on a preliminary assessment
of the charge as follows:

 

Estimated time in searching and retrieving the documents:

 

The estimated time in searching and retrieving the documents is 15 hours.
The Freedom of Information (Charges) Regulations 2019 (FOI Charges
Regulations) sets the charge for searching and retrieving documents at $15
per hour. $15 multiplied by 15 is $225.

 

Estimated time for decision-making

 

The FOI Charges Regulations provides for a charge for time spent
decision-making (examining documents, making deletions, notifying the
applicant of the decision), at $20 per hour for every hour after the first
5 hours.

 

The estimated time for decision-making is 8 hours. As the first 5 hours
are not charged, the applicable charge is for 3 hours. $20 multiplied by 3
is $60.

 

Total

 

$225 plus $60 comes to a total of $285.

 

Your rights

 

You have a right to contend that the charge has been wrongly assessed or
should be reduced or not imposed.

 

Financial hardship is a factor that must be taken into account. FOI
Guidelines provide that financial hardship exists when payment of the debt
would leave you unable to provide food, accommodation, clothing, medical
treatment, education or other necessities for yourself or your family, or
other people for whom you are responsible.

 

If you believe the imposition of this charge would cause financial
hardship, please provide evidence that you rely on. For example, the
receipt of a pension or income support payment, evidence of income, debts
or assets.

 

Your obligations

 

You have an obligation to notify the Library, in writing, within 30 days,
that you either:

 a. agree to pay the charge, or
 b. dispute the charge, including seeking waiver or reduction, or
 c. withdraw the FOI request

If you fail to respond within 30 days, this request will be taken to have
been withdrawn.

 

Paying the charge

 

If you agree to pay the charge of $285, please provide, in your response,
the below information:

Address (including city, State, postcode)

 

If you agree to pay the charge and provides the above information, the
Library will then issue an invoice for the payment of the charge, with
details on how pay the charge.

 

Please note that the Library only collects your personal information for
the purpose of processing your FOI request, including processing an
invoice for the payment of the charge under the FOI Act. The Library will
not use or disclose your personal information for any other purpose.
