Affairs.

2)      if you are seeking to access documents of a state or local
government agency, as each Australian state and territory also have
separate FOI legislation that governs information held by state government
agencies, please contact the relevant agency as to how to make an
application to access the documents. For example, if you are seeking
access to police report from NSW Police Force, it is governed by the
Government Information (Public Access) Act 2009 (NSW) (GIPA Act), and you
will need to contact NSW police to find out how to make a GIPA application
for the police report.

3)      if you are seeking to access documents of a private organization,
which the FOI Act does not apply to, please contact the organization

Thank you for your email received by the Office of the Australian
Information Commissioner (OAIC) on 30 August 2023. I understand that you
are making a request for documents under the Freedom of Information Act

I am of the view that the OAIC does not hold the documents you are seeking
access to and that your request would be better directed to The Uluru
Statement from the Heart organisation.

The Office of the Australian Information Commissioner

The OAIC regulates the [1]Privacy Act 1988 (Cth) (the Privacy Act) and the
[2]Freedom of Information Act 1982 (Cth) (the FOI Act). The OAIC has the
power to investigate [3]complaints about the alleged mishandling of
personal information by Australian and Norfolk Island government agencies
and many private sector organisations, as well as the power to [4]review
FOI decisions of Australian and Norfolk Island government agencies. We are
also responsible for handling privacy complaints about ACT public sector
agencies.

Each Australian state and territory also have separate FOI legislation
that governs information held by state government agencies.

The OAIC does not:

o have the function to provide information on matters not covered by the
Privacy Act or the FOI Act.
o hold records of other Commonwealth government agencies or private
organisations.

If you are seeking to access records of a particular agency or
organisation, you will need to make your request directly to the relevant
agency or organisation.

The OAIC only has the power to investigate alleged mishandling of personal
information by Commonwealth government agencies and privacy organisations
under the Privacy Act 1988 (Cth), and we are responsible to review FOI
decisions made by Commonwealth government agencies. This means, for
example, if someone makes a complaint about another Commonwealth agency or
private organisation under the Privacy Act that it breached their privacy,
the OAIC will then open up a file. That person who made the complaint can
then ask OAIC to provide that file to them. Or if someone makes a
complaint about the FOI decision made by another Commonwealth government
agency, the OAIC will then open up a file for that FOI review, which is on
our record.

We do not hold all records of government agencies of Australia. We do not
hold records of state government agencies because each Australian State,
has separate law about accessing state government agency documents.

I consider that your request would be more suited to The Uluru Statement
from the Heart organisation and recommend that you make your request to:
