While I understand that processing this FOI request may involve substantial work, I believe transparency around the appointment of Amplar Health as the sole provider of virtual nursing services under the Aged Care Virtual Nursing Project is a matter of significant public interest.
To make my request more specific, I would like to request:
- All documents outlining the decision-making process, including but not limited to internal briefings, meeting minutes, evaluation criteria, procurement or tendering documentation, and approval memos;
- Any documents (including emails, meeting notes, or records of discussions) that consider or reference alternative providers to Amplar Health;
- Any conflict of interest declarations or probity reports associated with the selection process;

On 22 April 2025, the department sent you a notice under section 24AB of
the FOI Act, stating the department intends to refuse access to documents
in accordance with your request on the basis a practical refusal reason
exists. The department invited you to revise you request so that the
practical refusal reason no longer exists during a consultation period. As
outlined in the notice, the consultation period was from 23 April 2025 to
6 May 2025.
As you did not revise your request, withdraw the request, or indicated
that you do not wish to revise the request before the end of the
consultation period, your request was taken to have been withdrawn. The
department sent you an email on 7 May 2025 to advise you that your request

in accordance with your request on the basis a practical refusal reason
exists. The department invited you to revise you request so that the
practical refusal reason no longer exists during a consultation period. As
outlined in the notice, the consultation period was from 23 April 2025 to
6 May 2025.
As you did not revise your request, withdraw the request, or indicated
that you do not wish to revise the request before the end of the
consultation period, your request was taken to have been withdrawn. The
department sent you an email on 7 May 2025 to advise you that your request
was taken to have been withdrawn.
However, the department will register your revised request as a new
request with statutory timeframes commencing from 9 May 2025 and process
it accordingly.
If you are not satisfied with the way we have handled your FOI request,
you can lodge a complaint with the OAIC. However, the OAIC suggests that
complaints are made to the agency in the first instance.
While there is no particular form required to make a complaint to the
OAIC, the complaint should be in writing and set out the reasons for why
you are dissatisfied with the way your request was processed. It should
also identify the Department of Health and Aged Care as the agency about
which you are complaining.
