Anti-Social Behavioural Disorder in the Australian Defence Force.

Michael made this Freedom of Information request to National Archives of Australia

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

Response to this request is long overdue. By law, under all circumstances, National Archives of Australia should have responded by now (details). You can complain by requesting an internal review.

Dear National Archives of Australia,

I am seeking the details of the study or report that led to ASPD being deemed ineligible for service in the ADF.

It is my understanding that people shown to exhibit the characteristics of antisocial behavioural disorder are discharged from service. This is common throughout the western world and has been so for around fifty years or so. I would like to examine this study. I understand it may not have been conducted in Australia. At this stage I don’t know the title or even the time it was conducted. Any assistance you could provide would be greatly appreciated.

Yours faithfully,
Michael Gould

FOI Shared Mailbox, National Archives of Australia

UNCLASSIFIED

Good afternoon,

Your request will be actioned in accordance with the Archives Act 1983
(Cth) and has been passed on to our National Reference Service for their
attention.

Your reference number is NAA1000134629.  Below is the receipt for your
information which advises how you can track the status of your request.

There are three ways to request access to records in the custody of the
National Archives of Australia (‘the Archives’) – under the Archives Act
1983 (Cth) (‘Archives Act’), the Freedom of Information Act 1982 (Cth)
(‘FOI Act’) or the Privacy Act 1988 (Cth) (‘Privacy Act’).

Under the Archives Act, requests can be made for archival records that are
in the ‘open access period’, which currently includes records created up
to including 1989. Under the Archives Act, all records are available to be
accessed by the public once they enter the [1]open access period unless
they contain material that falls into certain [2]exemption categories
under section 33 of the Archives Act. Types of records which can be
accessed under the Archives Act include records relating to family history
such as immigration, citizenship and war service records. You can read
more about access to archival records and the open access period in our
fact sheet on [3]access to records under the Archives Act.

Freedom of Information requests made to the National Archives of Australia
are used to obtain access to:

o records relating to the current administration and practices of the
Archives;
o records in the closed period that relate to the administration and
practices of the Archives; and

·       records in the open access period that are in the Archives’
custody that contain your personal information.

The Privacy Act 1988 (Cth) provides the right to request:

·       access to records that contain your personal information;

·       correction of your personal information because the information is
inaccurate, out-of-date, incomplete, irrelevant or misleading.

Although the Privacy Act provides you with a right to make requests where
your personal information is involved it will not apply in all
situations.  For example, you cannot use the Privacy Act to request
records containing your personal information that are in the open access
period.

For further explanation on which Act to seek information under, please
refer to our fact sheet on [4]when to use the Freedom of Information,
Archives and Privacy Acts.

Please use the contact information in the below email if you if you have
any further questions.

Dear Mr Gould,

Thank you for contacting the National Archives of Australia. Over the last
six months our National Reference Service has experienced a very high
volume of inquiries and as a result some responses have been delayed
significantly. We apologise for the delay in responding to your inquiry
and we appreciate your patience.

As your initial request was received over 30 days ago, I am writing to ask
whether you still require the information you sought from the Archives.
Since registering your inquiry you may have received the information you
need from another office of the National Archives or from another
organisation. Could you please respond if you still require the
information by emailing [email address]. When responding, please
quote your inquiry number (NAA1000134629). There is no need to respond if
no further action is required.

Please note that our Reference Officers cannot undertake detailed research
on behalf of members of the public. We can however provide advice as to
where to start your research and how to use our databases and finding
aids.

As an alternative you may wish to engage a research agent to conduct
research on your behalf. There are lists of research agents provided on
our website. These can be accessed by visiting our [2]Fact Sheets page.

We thank you for your understanding and assistance with this follow-up
process.

Yours Sincerely,

Karan Oberoi
