Dear Department of Home Affairs,

I note the draft investigation findings of innumerable contraventions of the APS Code of Conduct (in s.13 of the Public Service Act 1999) recently put, for procedrual fairness reasons, to stood down Secretary of the Department of Home Affairs, and crooked Liberal Party grub, Michael Pezzullo.

Under the FOI Act, I seek a copy of every email contained in the whole of Michael Pezzullo’s Home Affairs’ issued email account containing the phrase ‘liberal.org.au’.

Documents failing within the scope of my request can be quickly identified and retrieved by searching the entirety of Mr Pezzullo’s email client (including sent and archived emails) using the search term ‘liberal.org.au’.

I'm happy to set out the wide public interest in the documents at issue by reference to particular acts engaged in by Mr Pezzullo as well as Ms Stephanie Foster's dealings with her crooked Liberal Party colleagues (eg. Phil Gaetjens and John Lloyd).

Charges do not apply to requests from individuals seeking access to

Information Commissioner reported that across the public service, the
average charge notified was $335.50 in 2020-21.

We do not provide personal details of staff

 

The Department’s practice is to exclude the personal details of staff not
in the Senior Executive Service (SES), as well as the direct contact
details of SES staff, contained in documents that fall within scope of an
FOI request. If you require personal details of non-SES officers, or
direct contact details of SES staff, please inform us so the decision
maker may consider your request. Otherwise we will take it that you agree
to that information being excluded from the scope of your request. However
names of staff that have previously been released in departmental
correspondence may be disclosed.

We do not provide duplicated documents

 

If the FOI decision-maker deems a document to be a duplicate, they will
not assess those pages as part of your FOI request. This means that if a
there is a decision to release the document to you, you will receive only
one copy, even if multiple copies of that document exist.

Publication of document

Released documents you request may be published to our website

 

Where documents are released to you in response to your request, the
Department may be required to publish these documents on its website
within 10 working days in accordance with section 11C of the FOI Act.
Publication will not be required where the documents contain personal or
business affairs information.

I note that subsequent to the making of my request it has been publicly confirmed, as a consequence of an independent investigation into Michael Pezzullo’s corruption, that Michael Pezzullo is a corrupt Liberal Party piece of shit. That of course necessarily heightens the wide public interest in the documents the subject of my request not least because they’re likely to disclose further misconduct engaged in by corrupt Liberal Party piece of shit, Michael Pezzullo.

Pursuant to paragraphs 6.153 and 6.154 of the Guidelines made by the Information Commissioner under s.93A of the FOI Act, I’m willing to consent to the redaction of the personal information of any person contained within a document that falls within the scope of my request except where that person is, or was at the relevant time, a public servant or statutory officer.

In that regard, I note that paragraph 6.154 of the Guidelines states:

“When considering whether it would be unreasonable to disclose the names of public servants, there is no basis under the FOI Act for agencies to start from the position that the classification level of a departmental officer determines whether his or her name would be unreasonable to disclose.”

Yet, according to your email, that’s exactly what the Department of Home Affairs does. Noting the obligation imposed on Departmental officers by operation paragraph 9A(b) of the FOI Act, the person responsible for devising and implementing the Department’s policy with respect to the disclosure of staff names in response to FOI requests has necessarily contravened ss13(1), 13(4) and 13(11) of the Public Service Act 1999.

As previously mentioned, I’m very happy to provide additional information in support of the wide public interest in the documents the subject of my request (for example, in response to a charges notice or access refusal decision) by setting out the details of acts of corruption engaged in by identified former and current senior Departmental officers.
