Jake Barry, Australian Broadcasting Corporation

Dear Scott,

I am writing to provide an update on your FOI request.

We would like to apologise for the delay in processing your matter. We are
currently dealing with an influx of large, complex requests that are
testing our resources and this has unfortunately on occasion caused quite
long delays for our applicants.

Our goal has been to ensure all documents relevant to your request are
retrieved, and we have continued to work on your request to this end.

The search, which was slightly drawn out, provided us with a number of
documents, some of which are quite large. Some documents also include
information that may fall outside of the scope of your request. As an
example, one document is 100 pages of Cabcharge receipts, some costs of
which were not incurred for the AFP matter.

The nature of the documents also requires extensive third-party
consultation with several parties who may be affected by the release of
the documents.

Your request appears to focus on a breakdown of the costs and whether they
were internal or external expenses, rather than the specifics of who was
involved in the litigation.

One of the documents that we have located is a breakdown of ‘actual’ and
‘expected’ costs for the AFP matter as at the end of the last financial
year. These costs were further broken down into categories (e.g.
barrister/solicitor costs, Cabcharge, travel). If we were able to update
this document to reflect the time period pertinent to your request – i.e
costs up to the date of your request – would you be amenable to us
creating this document and assessing it, solely, for release under the FOI
Act?

Please note that this does not guarantee that the document will be
released to you.

I would appreciate if you could advise us of how you wish to proceed, and
we’re happy to discuss this further with you if you wish so that we can
have the fullest understanding of the specific documentation you seek.
Please feel free to contact myself or Juliana Walsh, the ABC’s FOI Advisor
([1][email address], (02) 8333 5304) to discuss further.

I note that as the ABC has not provided you with a decision within
statutory time limits, you can apply for Information Commissioner review
on the basis of what is called a ‘deemed refusal’. We would continue to
process your request with a view to providing a decision as quickly as
possible, even while you went through that process. Information about IC
review is here:
[2]https://www.oaic.gov.au/freedom-of-infor...

Thank you again for your patience, and again please feel free to contact
me should you have any questions or concerns.

Jake
