FOI internal review

Dear National Disability Insurance Agency,

I am lodging a request for access to documents under the Freedom of Information Act 1982 (Cth).

I seek access to any documents, data, or records that contain or summarise the following information for the most recent four financial years.
1. The total number of internal review requests lodged in relation to FOI decisions made by the agency.
2. The number (and/or percentage) of those internal review requests finalised within the statutory timeframe under the FOI Act.
3. The number (and/or percentage) of internal review decisions that overturned or varied the original FOI decision, specifically where access to information was subsequently granted (in full or in part) after an initial refusal.

If available, I would appreciate if the information could be provided in a simple statistical or tabular form.

Dear Miles,
 
Thank you for your correspondence of 11 November 2025, in which you
requested access under the Freedom of Information Act 1982 (FOI Act) to
documents held by the NDIA.
 
Scope of your request
You have requested access to documents held by the NDIA. Specifically, you
requested access to:
 
“… I seek access to any documents, data, or records that contain or
summarise the following information for the most recent four financial
years.
        1.      The total number of internal review requests lodged in
relation to FOI decisions made by the agency.
        2.      The number (and/or percentage) of those internal review
requests finalised within the statutory timeframe under the FOI Act.
        3.      The number (and/or percentage) of internal review

specifically where access to information was subsequently granted (in full
or in part) after an initial refusal...”
 
Processing timeframes
Under section 15(5)(b) of the FOI Act, we are to provide you with a
decision on your request within 30 days after the date on which your
request was received. This statutory time period for the processing of
your request commenced on 12 November 2025. This means that the date by
which to provide you with a decision on your request is 11 December 2025.
 
It may become necessary to extend this time period, including if we
require additional time to deal adequately with your request or if we need
to undertake consultation with third parties. I ask that you consent to a
30-day extension of the timeframe under section 15AA of the FOI Act to
ensure your internal review rights are preserved if we’re unable to meet
the 30-day timeframe. Should you agree to a 30-day extension of time, the
new date to provide you with a decision on access to documents would be 10
January 2026, although I will endeavour to provide a decision sooner if
possible. Please advise by COB 5 December if you agree to the extension of
time.
 
Irrelevant material
Section 22 of the FOI Act permits agencies to release edited copies of
documents, which have been modified to remove information that is
irrelevant to the request.
 
Many NDIA records contain the middle names, family names, and direct
contact details of NDIA staff. We have found that most applicants agree
that these details are not relevant to the information which they seek to
access.
 
We kindly ask that you please respond to this email and confirm whether
the middle names, family names, and direct contact details of NDIA staff
are irrelevant to your request.
