Ben Fairless made this Freedom of Information request to Australian Communications and Media Authority

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

The request was partially successful.

Dear Australian Communications and Media Authority,

I would like a copy of any complaint made in relation to Click-To-Call, BetCall, or any other service offered in 2015 by Australian licensed online betting operators that ACMA referred or declined to refer to the AFP in the last 12 months.

Can you also provide a copy of any referral made to the AFP?

Please initially this as an informal request for information. If it cannot be treated in this way, consider it a formal Freedom of Information request.

Yours faithfully,

Ben Fairless

Dear Phyllis Fong,

Thanks for getting back to me. Your interpretation is correct.

In order to reduce the scope, could you exempt:
- personally identifiable information of individuals and employees of businesses (eg. names, Telephone Numbers, email addresses and physical addresses)
- exempt duplicates of documents.

Is it possible for this request to be processed administratively, that is outside of the FOI Act?

Yours sincerely,

Ben Fairless

Dear Mr Fairless

Thank you for confirming the scope of your request for access to documents
(access request) and for agreeing to exempt personally identifiable
information of individuals and employees of businesses and duplicate
documents. On this occasion, the Australian Communications Media Authority
has decided to characterise your access request to be under section 15 of
the Freedom of Information Act 1982 (the FOI Act).  This is because the
documents falling within the scope of your access request contain a third
party’s business information and it is very likely that third party will
object to the release of the relevant business information under section
47G of the FOI Act.  Accordingly, your access request in this matter is
better handled by the third party consultation procedures under the FOI
Act rather than as administrative access.

Sincerely

Phyllis Fong
