Processing Timeframes

In accordance with section 15(5)(b) of the FOI Act, a 30-day statutory
period for processing your request started 2 May 2025. This 30-day period
expires on 1 June 2025.

 

The 30-day period can be extended in a number of ways, including with your
agreement.

 

Extension of Time Request:

Unfortunately, it is currently taking us a little longer than 30 days to
process FOI requests due to a very high volume of incoming matters. I am
therefore seeking your agreement to a 30-day extension of time under
section 15AA of the FOI Act. If you agree to this extension, the new due
date for us to decide on your request will be 1 July 2025.

 

Please let us know if you agree by Thursday 29 May 2025.

 

Explanation of Extension of Time Request:

The reason I am seeking an extension of time is to ensure I preserve your
review rights under the FOI Act.

FOI applicants are normally entitled to exercise a right of internal
review if they are unsatisfied with the outcome of an FOI decision.
However, this right of review lapses if a FOI decision is not made within
the statutory timeframe. This is because if an agency doesn’t issue their
decision within the statutory timeframe, they are deemed to have refused
the request for documents. If this situation happens, it will limit your
options for formal review to only contacting the OAIC.

You are not obligated to agree to this request, you would still retain
your review rights with our regulatory body OAIC (Office of the Australian
Information Commission).

 

Irrelevant Information

Section 22 of the FOI Act allows an Agency to redact information from
documents if that information would reasonably be regarded as irrelevant
to a request for access.

 

Given the nature of your request, it does not seem that NDIA staff
members’ surnames and contact details would be relevant to you. Can you

I'd like to seek your assistance to revise the request so it can be completed. I'm happy to keep lines of communication open whilst we find a solution rather considering my suggestions below to be the final revised scope.

I’m looking for emails that discuss the decision to include/remove/edit the item “What are flexible and stated supports? (new)” on the “Frequently asked questions about legislation” webpage.

The list of staff I included is long because I have no concrete knowledge of who would be involved in that sort of decision. If I had to choose, I suppose I would say Shannon Rees, Elyse Moore, Corri McKenzie and Thomas O'Byrne would be the highest priority; but I included everyone I did on that list because, from my outside perspective, all of them are plausible options.

Can I suggest trying the following search criteria ("AND" meaning that the result must include both terms/phrases):

Thank you for looking into it further.

Am I right to assume 993 matches would still incur a practical refusal, as it still comes out to 16.5 hours processing time? But the 392 matches at 6.5 hours would be acceptable? If search 1 wouldn’t incur the practical refusal using the scope you’ve suggested, that certainly would be my preference over search 2, but I wouldn't want to proceed with any scope that can't be completed.

Brainstorming another option for hopefully hitting somewhere between the two, would a split like this help?

Search 1 provided 395 possible matches, and Search 2 was a NIL result.

I'm concerned that limiting the request to only the specific item in question may cause more tangentially relevant information to slip through the cracks, but I'd be happy to update the scope with this:

and/or

- Discuss current or proposed agency guidelines/policies on how "stated supports" are described in a participant's NDIS plan.
