Dear Mr Ashmore,

I refer to your FOI request lodged with the Administrative Appeals
Tribunal (AAT) on 2 July 2020.

Your request

You have requested access to:

NUMBER OF NEW APPLICATIONS TO THE AAT BY VETERANS:

I request the number of applications made to the AAT by veterans following
the rejection of their claim by DVA and/or the VRB for the following
period:

·          1 July 2018 to 31 December 2018,

·         1 January 2019 to 30 June 2019,

·         1 July 2019 to 31 December 2019, and

·         1 January 2020 to 30 June 2020.

Clarification of your request

The AAT review a range of decisions in relation to veterans’ entitlements
and military compensation, primarily decisions made under the following
laws, where the legislation allows us to review those particular
decisions:

•             the Military Rehabilitation and Compensation Act 2004,

•             the Safety, Rehabilitation and Compensation (Defence-related
claims) Act 1988, and

•             the Veterans’ Entitlements Act 1986.

Information on what the AAT cannot review is found on our website at
[1]https://www.aat.gov.au/apply-for-a-revie....

You have requested statistics on the number of applications lodged by
veterans to the AAT. The AAT can only provide information relating to
applications for review of particular types of decisions, and not based on
the identity of applicants (i.e. veterans).

This means that we cannot provide statistics in the form that you have
requested. However, we can provide data on the number of applications
lodged with the AAT based on the type of decisions made by the Department
of Veterans Affairs (DVA) and/or the Veterans Review Board (VRB). These
decisions are reviewed in the Veterans’ Appeals Division of the AAT.

We seek your agreement to amend the scope of your request to the
following:

The number of applications lodged in the Veterans’ Appeals Division for
the following periods:

•             1 July 2018 to 31 December 2018,

•             1 January 2019 to 30 June 2019,

•             1 July 2019 to 31 December 2019, and

•             1 January 2020 to 30 June 2020.

Please let me know whether you agree with the revised scope at your
earliest convenience.

I look forward to hearing from you.

Kind regards,
