Radioactive Waste Expansion Project in Yallambie

Sun Shine made this Freedom of Information request to Australian Radiation Protection and Nuclear Safety Agency

The request was partially successful.

From: Sun Shine

Delivered

Dear Australian Radiation Protection and Nuclear Safety Agency,

I seek access under the Freedom of Information Act 1982 (FOI Act) to information regarding the Australian Radiation Protection and Nuclear Safety Agency's (ARPANSA) project to expand its Radioactive Waste Store.

ARPANSA provided information to staff via Powerpoint in April 2018 dealing with the waste store expansion project at ARPANSA's Yallambie office. This presentation addressed the proposed transport and storage of additional waste in Yallambie and timelines for project completion. Request access to documents that describe the project, including the presentation made to staff in April 2018.

This request involves no information of a personal nature or information involving third-parties.

Yours faithfully,
Anonymous

Dear $ARPANSA FOI,

I note that the 30-day deadline is approaching. I respectfully request that you respond to my FoI request by providing the relevant documents this week.

The requested information is in the public interest. I believe the project involves a significant expenditure of public money, major modifications to ARPANSA's building in Yallambie and a change to scope of ARPANSA's own licence. Disclosure will inform debate on a matter of public importance and promote effective oversight of public expenditure.

Yours sincerely,
Anonymous

Dear Sun Shine,

Thank you for your email. I have been provided with a substantial number of documents that may respond to your request, however, due to some unexpected leave taken by ARPANSA's Facility Manager, I only received all the documents this week. While I will endeavour to make a decision on the documents as soon as possible, I think that next week is more likely than this week.

Regards,

Martin

Dear $ARPANSA FOI,

Thank you. The FoI Act requires you to act as soon as practicable, and no later than 30 days, after receiving the request (s 15(5)(b)).

I don't think this request is voluminous or complex, and I don't agree to extend the time. This request doesn't appear to meet the criteria for extension. Please comply with the Act by providing the requested documents [I'm not interested in justifications for or against] or obtain Information Commissioner approval this week.

Yours sincerely,
Anonymous

Dear ARPANSA FOI,

I did not receive notice of your decision, despite my reminder to you last week.

Although you stated that you have the requested documents, you appear unwilling to release them. The time has expired. I must therefore conclude that the CEO of ARPANSA has personally made a decision refusing to give access to the documents [refer to s 15AC].

Yours sincerely,
Anonymous
