I'm asking for this information because your past decisions have noted that a person can make more than one access request during a quarter, so the "total number of access requests received during the quarter" figure cannot be compared to any of the "person level" figures provided.

Processing Timeframes

In accordance with section 15(5)(b) of the FOI Act, a 30-day statutory period for processing your request commenced from 3 July 2025. This 30-day period expires on 1 August 2025.

The 30-day period can be extended in a number of ways, including with your agreement.

Extension of Time Request:

Unfortunately, it is currently taking us a little longer than 30 days to process FOI requests due to a very high volume of incoming matters. I am therefore seeking your agreement to a 30-day extension of time under section 15AA of the FOI Act. If you agree to this extension, the new due date for us to decide on your request will be 31 August 2025.

Please let us know if you agree by 8 July 2025.

Explanation of Extension of Time Request:

The reason I am seeking an extension of time is to ensure I preserve your review rights under the FOI Act.

FOI applicants are normally entitled to exercise a right of internal review if they are unsatisfied with the outcome of an FOI decision. However, this right of review lapses if a FOI decision is not made within the statutory timeframe. This is because if an agency doesn’t issue their decision within the statutory timeframe, they are deemed to have refused the request for documents. If this situation happens, it will limit your options for formal review to only contacting the OAIC.

You are not obligated to agree to this request, you would still retain your review rights with our regulatory body OAIC (Office of the Australian Information Commission).

Irrelevant Information

Section 22 of the FOI Act allows an Agency to redact information from documents if that information would reasonably be regarded as irrelevant to a request for access.

Given the nature of your request, it does not seem that NDIA staff members’ surnames and contact details would be relevant to you. Can you please send me a reply email confirming that such details are irrelevant to your request for access?

Dear Patrick,

I have two follow up questions to better understand your decision, if you are able to please reply:

1. Did the Analytics, Data and Actuarial Division provide any explanation for why they are unable to provide the information in a s17 generated document? (Reasoning more detailed than "they are unable to generate a document")

Is it because the ADA don't track this data at all? Or because it would take too much work for them to write a method to extract that data from the database and confirm its accuracy?

I'm confused as to how the ADA are able to tell me 'the number of people awaiting an access request decision', but they supposedly can only tell me 'the number of access requests received this quarter' rather than 'the number of people who made an access request this quarter', considering how closely linked all of those things would be.

2. The FOI Decision Notice is dated "5 August 2025" but you sent it to me on 5 September 2025. Was the decision completed a month ago and I wasn't informed until now, or is this a typo?

I apologise, regarding question 2, that was a typo, it should be 5
September 2025.

 

Regarding question 1, I unfortunately am not an expert in data and note
that these issues are quite complex, however I will try my best to
explain.

 

From my understanding, and conversations with the Analytics, Data and
Actuarial Team regarding this point:

 

Is it because the ADA don't track this data at all? Or because it would

the database and confirm its accuracy?

 

Both are correct. ADA have explained that data regarding access requests
is collected at a point in time (end of each quarter) from the real time
raw data, however person level data is not collected in this process. This
is because:

 

 1. There is no operational need for this data
 2. There would be difficulties with current data reporting practices
(extracting from real time data) that would make any person level
figure potentially inaccurate

 1. For example, if a person were to submit three access requests,
one on 28 June, one on 29 June and one on 2 July, the person
level data would be represented as one person requesting in
quarter 4 and one person requesting in quarter 1 which would be
an inaccurate report if we count the same person more than once
over several quarters.

 

As such, because there is no operational use, and issues with reporting
that would produce inaccurate results, ADA also do not have a method for
extracting the person level data.

 

I hope this provides a bit more context regarding why ADA are unable to
produce the data you have requested.

Thank you for explaining.

Hopefully the agency will respond soon and finalise my requests for the number of people in the access request queue at the end of Q4 (FOI 25/26-0001 https://www.righttoknow.org.au/request/n...) and my usual access request stats request for Q4 (FOI 25/26-0019 https://www.righttoknow.org.au/request/n...) which will help us get a better picture of the situation.

If there's anything you can do to follow up those requests as both are currently overdue I would be grateful.
